After commencing legal proceedings against a New South Wales-based retailer/wholesaler for copyright infringement relating to the parallel importation of Private films, Adult Indusry Copyright Organization (AICO) members Private and Cal Vista have obtained an out-of-court settlement which includes the payment of $200,000 by the retailer.
As part of the settlement, permanent undertakings have also been given by the retailer/wholesaler to the effect that it will not import or sell any parallel imported Private films. Cal Vista Australia Pty Ltd is the exclusive licensee of all Private films for Australia and New Zealand.
AICO executive officer Graeme Dunne, said, "This substantial monetary settlement shows that
unauthorized dealing in parallel imported films exposes adult film retailers and wholesalers to the same range of legal actions and penalties as dealing in counterfeit copies.”
Under the terms of settlement, the identity of the retailer/wholesaler cannot be disclosed.
