The Pasadena City Council avoided a possible lawsuit Monday by dropping an emergency ordinance meant to keep adult businesses from setting up shop here.
The council had scheduled a second reading of the ordinance that called for a 45-day moratorium on allowing adult businesses to move into the city in order to permit the city to develop a permanent measure on the subject, the Pasadena Star News reported.
But attorney Roger Diamond said he would have sued the city if the measure was passed since it would have come less than three weeks since his client, Greg Hakopyan submitted a business license application to open what would be the city’s second adult store.
Council members said they dropped moratorium because there were unresolved Constitutional questions on the matter. Officials said Hakopyan’s application will now be processed.
But the council would still review new regulations on such businesses, Mayor Bill Bogaard said.
Hakopyan plans to open his shop at a former Shakey’s Pizza location at 2180 E. Foothill Blvd.
