The state's highest court, The Court of Appeals, has decided to give residential neighborhood businesses dealing in adult entertainment some time to prove they have sufficiently cleaned up their act, according to a published report. Previously, a store or club could operate within a neighborhood, in the state of New York, as long as 60 percent of its merchandise was not of a sexual nature.
Herald Price Fahringer, an attorney for several of the stores in question, said that two experts, including a professor from Columbia University, would testify that there is no negative social impact from the stores, and that the city is relying on old data that does not reflect changes in the stores' operations.
