HVL Cyberweb Solutions, the parent company of Braincash, has filed a breach of contract lawsuit against Peter North’s NorthPole Enterprises in Orange County Superior Court.
Braincash has marketed North’s content online for the past four years through sites like PeterNorth.com.
The rift stems from North’s desire to move his content to another online operation, despite being under contract to HVL. In filing the suit, HVL is aiming to protect the intellectual property rights of the company.
North claims to own the copyrights to all of his movies, many of which make up his online presence. PeterNorth.com is registered by HVL.
“It’s unfortunate that we have to get to this point, but I am confident about my position, and I know I will win this case as I have done everything correctly,” North says in a statement. “I firmly disagree with the claims Braincash included in the lawsuit. I am a respected producer. I run a clean business and will protect my assets in court.”
HVL president Frederic Valiquette says North has refused all attempts to settle the matter outside of court, including mediation.
“We have been trying for months to meet with NorthPole to reach a resolution that makes business sense,” Valiquette says. “NorthPole hasn’t even returned our calls. They’re not interested in coming to a sensible resolution.”
Despite the disagreement, Braincash’s Web operations have continued as usual.
