Anabolic Video Productions has sent a Cease and Desist Demand to Platinum X Pictures regarding a scene in Platinum X's Euro Girls Never Say No, Vol. 1.
Bonnie Kail, the director of sales for Platinum X, and Larry, the comptroller, told AVN.com Monday that Anabolic's issue is with a scene where Jean Yves Lecastel is wearing an Anabolic T-shirt and joins in the sex scene. Anabolic, in a letter from its attorney dated July 21, maintains this is violation of its trademark and ordered Platinum X to cease selling the video immediately, among various other demands.
"Our position is that this is a T-shirt that is produced for the sole purpose of marketing a name and identity and once it's sold or given away, it's in the public domain," Larry told AVN.com. "There was nothing negative about it (in the video.) There was nothing intentional. From our point of view, it's a great sales tool for Anabolic."
Anabolic executives were not available for comment at press time Monday.
Kail said that she did not even notice the Anabolic logo T-shirt until the video was shipping to the East Coast in late May.
"It was not pre-meditated," she said.
Steve Holmes and Manuel Ferrara, who are independent contractors working for Platinum X, own the title and shot it in Europe. The original street date was May 20, and Kail said that until her company received this letter last week that Platinum X was processing re-orders on the popular video.
She told AVN.com that Platinum X currently was not shipping any more copies and was taking steps to re-edit it, removing the portion of the scene where the Anabolic shirt is visible. Kail said that in the letter Anabolic also demanded a recall on all of the videos that already have been sold. In addition, Anabolic has requested all of Platinum X's sales invoices related to the title, she said.
