The owner of an adult store has sued the North Texas city of Richardson, claiming its regulations for adult businesses are illegal.
Adjust Video Inc., which owns the Zone D'Erotica store has sued the city claiming its regulations for adult businesses are unconstitutional and that its store should be allowed to operate, CBS11 News in Dallas reported.
The store had been scheduled to open this summer.
At issue are city regulations which claim any business that sells sexually-explicit materials is an adult business and must then apply for a special permit before it can do business.
But in its suit, the Adjust Video claims the law is too vague and that it wrongly classifies its new shop as an adult business.
The store sells health care products as well as adult videos, clothing and adult novelties.
Peter Smith, an attorney representing the city, said Richardson will fight the lawsuit to protect its regulations and that it will not allow an adult store to operate in the city.
