‘Grand Theft’ Video Game Maker Settles over Sex Images

Take Two Interactive Software has settled with the Federal Trade Commission over allegations that it failed to disclose that its video game “Grand Theft Auto: San Andreas” contained indecent sexual images, the company said Thursday.

The FTC had charged the company with not revealing the fact that its game contained “potentially viewable nude female characters and a potentially playable sex mini-game.”

The sexual content could be viewed by accessing a program called “Hot Coffee.”

Terms of the settlement were not disclosed.

By law, Take Two and its Rockstar Games division which put out the game, are required to “clearly and prominently disclose” on its packaging and on promotional materials content considered relevant to its ratings and also must ensure that its games’ contents are examined and considered in its submissions to the ratings board.

The game had received an “M” for mature from the Entertainment Software Rating Board, meaning it’s meant for ages 17 and over due to its content. But the sex images were not discovered until after the rating had been issued, FTC said.
