BOGOTÁ—The Constitutional Court of Colombia ruled in favor of popular porn star and adult content creator Esperanza Gómez last week in a lawsuit she brought against Meta Platforms, the American parent company of social media networks including Facebook, Instagram, Threads, and secure messaging app WhatsApp.
The South American country's highest court ruled that Meta violated Gómez's freedom of expression when it arbitrarily deleted her Instagram account of more than five million followers. Instagram did so "without a clear and transparent justification" for such or taking the same action against similar account users.
Gómez, 45, is one of Colombia's most popular adult content performers. This decision is noteworthy because this is the first time Colombia's high court ruled in favor of content moderation equity in alignment with the rights of digital content influencers. The court found that this removal was arbitrary and illegitimate.
The high court notes that Meta "violated the fundamental rights of Esperanza Gomez by deleting her Instagram account with more than 5 million followers without a transparent and clear justification, and without granting her equal treatment compared to profiles with similar publications."
Gómez has appeared in over 100 scenes throughout her career, including for brands and studios such as Brazzers, Naughty America and BangBros, among others.
