LAS VEGAS, NV — Porn studios are finally starting to put the smack down on tube site pirates and the latest example features three of the largest gay adult studios in the business. Corbin Fisher, Titan Media and Channel One Releasing have won a preliminary injunction against tube site operators GLBT, Ltd. in their long-running infringement suit.
The $29 million dollar lawsuit took a turn in early August when the studios filed a motion for terminating sanctions, as the defendants had destroyed evidence relevant to the case.
The studios then filed for a preliminary injunction to stop the tube site’s operators from dispersing their assets in an effort to avoid the consequences and inevitable judgment.
"We caught them taking actions to move assets out of the United States," said Marc Randazza, general counsel for Corbin Fisher. "They clearly know that they are losing the case."
This week, a federal judge granted the studios' injunction.
Preliminary injunctions are difficult to win. In laymen's terms, it basically states that one party, in this case, the plaintiff, has shown such a strong case that the other party would all but lose if the case went to trial. The injunction orders, among other directives, that the GLBT, Ltd. domains, including gayforit.com, itsallgay.com and jerkyourtube.com, be put into receivership pending resolution of the suit.
"Once again, it shows the power of content providers banding together to exterminate the piracy that ultimately harms not only the industry itself, but the people employed in the industry - from performers to programmers," Randazza added.
The tube site owners were also ordered to avoid any further actions that would dissipate their assets.
