A federal grand jury has indicted two California men for sending spam emails.
The three-count indictment charges Joshua Edward Eveloff and Michael Steven Twombly with conspiracy and fraud in connection with the generation of commercial electronic mail messages.
Eveloff and Twombly allegedly sent unsolicited and untraceable commercial emails in bulk for profit. The indictment claims the pair was sending more than 2,500 messages a day and more than 250,000 a year with false or misleading header information.
According to the indictment, the defendants managed businesses under the names Software Factory Solutions, Markshire Worldwide, and Interactive Midnight Inc., and used false names such as Michael Crawford, Michael Murphy, and Michael S. Anderson to lease dedicated servers.
Eveloff and Twombly each face up to three years in prison and a $250,000 fine on the fraud charge and five years and $250,000 on the conspiracy charge.
