Jerry Sullivan is the owner of Caf? Risque here on I-85, a topless-and-g-string restaurant that just got approval to stay in business.rnrn

"When I filled out the application and they asked 'What kind of restaurant is it?' I just put down '24 hours'" Sullivan told AVN.com. Caf? Risque caters to mostly truckers and tourists in this 8,000-soul northern Georgia town.rnrn

One day after Caf? Risque opened in October, 2001, it was closed down. Not for obscenity, but because the Lavonia City Council claimed Sullivan lied on his application. If so, it was a sin of omission. "There was nothing on the application that asked if it was gonna be a nudie place or not."rnrn

Sullivan's lawyers determined that an adult entertainment zone had been demarcated in Lavonia, but no zone had been approved by the city commissioners. Therefore the area was ripe for adult establishments and Sullivan believed he'd have an easy fight. He was open as a restaurant again in a week. Two months later he was "approved for pasties - with five feet of distance," and finally, after a protracted legal struggle, was allowed to go topless again late last year.rnrn

"Basically the city saw they were fixin' to get their butt kicked," Sullivan told AVN.com, "so I said, 'Hell, I'll drop my lawsuit if you grandfather me in topless.'"rnrn

Sullivan had filed an emergency injunction when he'd been closed down, but the judge said Sullivan "had unclean hands" and didn't see the need in an election year to reopen a topless restaurant. Now Sullivan has been awarded his legal fees and has no distance restrictions between waitress and customer.rnrn

"We've got great steaks, baked potatoes, and our hamburgers are the best," Sullivan said. "We don't need alcohol."rnrn

Caf? Risque is located at Exit 173 on I-85, Georgia.
