Pee Wee's Child Porn Case Continues: Judge

Actor Paul (Pee Wee Herman) Reubens's child porn case will continue, after his attorneys' second try to stay proceedings and suppress evidence in the case was refused by a Los Angeles Judge June 10.

The defense argues the case should have been thrown out four months earlier because the 1989 law under which Reubens is being prosecuted doesn't apply to material produced before it was enacted, according to the Associated Press. They also argued the statute of limitations for a misdemeanor crime expired before the actor was charged in November 2002.

Reubens' attorneys claim what he owns is a "collection of vintage erotica," the AP said. But prosecutors said Judge Carol H. Rehm's latest ruling would be upheld on appeal.

Reubens is free on $20,000 bail and has pleaded innocent in the case. He's charged with possessing material depicting children under 18 in sexual conduct, for which he could get a maximum year in jail and $2,500 fine if convicted, the AP said. A search of his home yielded his art collection and personal computers to police.
