Pee Wee Appeals Child Porn Charge

On grounds that the law under which he's charged doesn't cover material made before it was enacted, actor Paul (Pee Wee Herman) Reubens has appealed a judge's refusal to toss a misdemeanor child porn possession charge out, the Associated Press reported March 19.

Attorneys for the actor filed the appeal March 17. They also argued the statute of limitations for a misdemeanor crime expired before the charge was filed last November, the AP said. But city aide Eric Moses told the AP he believed Reubens would lose the appeal.

"We believe the trial court ruling was well reasoned and consistent with law, and the defendant's petition makes the same exact argument that failed to persuade the trial court judge," Moses told the news wire. When the appeals court rules, however, is unknown at this time.

Reubens was hit with this charge after a police search at his home last November. The 50-year-old actor could face a year in jail and a $2,500 fine if he's convicted.
