The Ohio Supreme Court ruled yesterday that Jennifer Dute should get a new trial.
The ruling upheld a June decision by the Ohio First District Court of Appeals that Hamilton County Common Pleas Court Judge Patrick Dinkelacker had erred by not allowing a video that had previously been deemed not obscene by a trial to be entered as evidence in her defense.
According to the Cinncinnati Post, Hamilton County prosecutors have not decided if they will appeal the decision to the United States Supreme Court, go forward with a new trial, offer a plea bargain or drop the charges.
Jennifer Dute, 33, was convicted last year of pandering obscenity and sentenced to one year in prison. She was imprisoned in December but was released after the winning her appeal.
Dute, who appeared in the videos having several types of sex with a multitude of partners, agreed following a 1999 conviction on similar charges that she would not sell her videos in or from Hamilton County.
