Obscenity Conviction Handed Down In Louisiana

The sale of Hustler's Barely Legal Volume 16 and Ladies Club to undercover officers led to the conviction of Dan Sasha Birman, owner of Fantasy Video, on obscenity charges.

Defense lawyer John Herbison said an appeal would be filed on Birman's behalf.

Birman faces three years in jail with a maximum fine of $2,500. Sentencing takes places on November 12.

Birman’s lawyers had attempted to have the case dismissed, arguing that the grand jury that indicted him was “irregular” since they only met for 45 minutes, not enough time to view the tapes completely. That motion was denied, the judge accepting the prosecutor’s argument that the grand jury was only supposed to view evidence.

Fantasy Video opened just outside Ruston in February of this year and immediately faced opposition from local religious leaders, who started a petition to have the store shut down. Birman started a petition of his own – his garnered more signatures.
