Obscene Rant on MySpace Found Constitutionally Protected

An angry, obscenity-laden MySpace rant by a local middle school student aimed at her principle has been ruled as constitutionally protected by the Indiana Court of Appeals.  The student, only known as A.B., was put on probation for the posting, but according to a recent report, the court has now ruled that the free speech rights of the girl were violated with that punishment.

According to WLWT News, the three-judge panel has ordered the Putnam Circuit Court to set aside its penalty against the girl, adding that they do not condone what was said, but the message itself adds up to political speech.

The angry rant posted on the popular website stemmed from a dress code policy that banned piercings. After the principal discovered the posting critical of the policy, the state filed a delinquency complaint against A.B., ultimately placing her on nine months of probation. A.B. appealed the ruling and won.
