NJ Town Holds Off Enforcing Nude Dance Ban

Until a judge in Bergen County hears both sides, this town will not enforce its new law barring nude dancing. And they're expecting a somewhat long fight of it.

Carlstadt Borough Attorney John Fahy told reporters the case would go at least to the New Jersey Supreme Court. "The U.S. Supreme Court has said this ordinance is OK," he said, referring to the high court's ruling in Erie v. PAPs. "But the New Jersey Supreme Court analyzes the First Amendment differently."

Carlstadt is also the home of Stiletto, called Bergen County's last all-nude club. On May 11 police passed summonses around the club because women wore no G-strings or pasties as the new law mandates, but the borough said they expect no more handed out until the case is resolved.

Opponents of the law filed a challenge that same day, since it was the day the law took effect. Arguments before the county judge are expected to begin next week.
