Accepting a warning that they might trigger a lawsuit, Town Council members here have reversed a decision to deny Amazing Express video store a Sunday sales license.
Town Solicitor John Verdecchia had warned the council, in a written opinion, that just because it was an adult-oriented business didn't mean Amazing Express's Sunday sales license could be denied. Verdecchia warned the council tryng to stop them from operating on Sundays overstepped First Amendment bounds with "impermissible content-based regulation".
Town Council vice president Joseph Wells said at last Monday's meeting that reconsidering the original license rejection doesn't mean the council condones Amazing Express's business.
"I guess it's kind of hard to deny it," he tells the Providence Journal-Bulletin. "If you have other businesses that are operating under the same circumstances, how can you say yes to one and no to the other?"
