Legal representation for singer Mariah Carey filed an opposition on Wednesday with the Trademark Trial and Appeals Board (TTAB) regarding starlet and gubernatorial candidate Mary Carey’s attempt to trademark her own name.
In her notice of opposition, Mariah Carey’s attorneys claim that Mary Carey’s name is “highly similar to [Mariah Carey’s name] in terms of sound, appearance and commercial impression,” and “based on the similarities and related nature of the goods described in [Mary Carey’s] application and registrations, the public is likely to mistakenly associate the goods offered by…Mary Carey with [Mariah Carey’s] goods and services.”
Mary Carey told AVN.com that she thinks there isn’t any likelihood that people will mix the two names up. “It’s pretty ridiculous, if you ask me,” said the starlet.
The legal process will officially begin today, and Mary Carey and her legal representation have forty days from Dec. 27 in which to file an Answer with the TTAB. Mary Carey, who recently left her contract with Legend Video, said she will be meeting with her attorney, David Beitchman, after the New Year to discuss the opposition process and procedures.
