Kim Kardashian Drops Vivid Lawsuit

Kim Kardashian has dropped her lawsuit that against Vivid Entertainment over the release of Kim Kardashian Superstar, the notorious sex tape she made three years ago with then-boyfriend, child actor/R&B artist Ray J.

"We are pleased that Kim has dropped her legal action against us," Vivid co-chairman Steven Hirsch stated in a press release.  "We met with her several times and finally reached a financial arrangement that we both feel is fair. We've always known we had the legal right to distribute this video which became an instant best-seller and we've always want to work something out with Kim so she could share in the profits."

Kardashian is rumored to have received $5 million in the settlement.

Vivid acquired the video footage in February from an undisclosed third party for a reported sum of $1 million. Kardashian filed suit against the company for violation of privacy in Los Angeles Superior Court on Feb. 21, claiming she had not authorized release of the footage. Kardashian's lawsuit described Vivid's actions in promoting and distributing the video as "despicable, offensive, outrageous, oppressive, and malicious."

"This tape, which was made three years ago, and was meant to be something private between myself and my then boyfriend, is extremely hurtful not only to me, but to my family as well," Kardashian said in a Feb. 21 statement to celebrity gossip site TMZ.com. "I am filing legal charges against the company who is distributing this tape since it is being sold completely without my permission or consent."

Vivid briefly delayed its release of the video while seeking a settlement with Kardashian, but failed to reach an agreement. Kim Kardashian Superstar hit the market March 21 and became an instant bestseller. The video is the first adult movie to debut on DVD and download-to-burn on the same day.

As part of her commitment to drop the lawsuit, Kardashian agreed to a lump sum financial settlement for the sale of the DVDs.
