Judge Rules Against Michigan Clubs in Ordinance Challenge

A lawsuit filed by Herb Newhouse, owner of the Little Red Barn Adult Theatre, and Mark London, owner of Sensation and Lady Godiva gentlemen’s clubs, was recently dismissed as a U.S. District Judge ruled that a city ordinance restricting activity at sexually oriented businesses is valid.

The ordinance bans full nude dancing, keeps patrons and dancers six feet apart, and mandates that dancers perform on stages at least 18 inches high. The ordinance also orders the removal of doors and partitions from peep show booths. The law has been active since the beginning of September.

Club representatives said that they are not giving up the fight. "Thank God we have the Sixth Circuit," Newhouse told the Grand Rapids Press, referring to an appeal filed after the Sept. ruling. "The city and judge rely on these so-called secondary effects of my business. Where were those in the first 34 years I've been here?”
