Hersch's Day in Court

Even though he said several weeks ago that he intends to make good on loan payments to producer Mark Spiegler, Herschel Savage's recent actions have more than contradicted his statements. In a declaration of due diligence, Spiegler proves that on five occasions attempts were made to serve Savage a lawsuit. Court documents show that between 11/17/99 and 11/22/99, deputy Marc T. Phillips went to Savage's residence five different times and found no one home. Phillips would arrive around 7 in the morning, a presumed time that Savage would be there. Finally, Spiegler had the papers nailed to Savage's door.

"Either he's really busy, or he's ducking the cops," says Spiegler. "I had somebody go over there and wait for him to get home. Then he still wouldn't answer the door, so they nailed it to his door. He {Savage] came out yelling, 'Is this how you serve somebody?' " Hersch's day in court is Dec. 14.
