FED JUDGE: TAMPA CAN'T THROW OUT VOYEURDORM SUIT

A federal judge has rejected Tampa's bid to throw out a lawsuit against the city by VoyeurDorm. The suit could determine whether the controversial adult Web site, based in a private residence, is an adult business under city zoning laws.

VoyeurDorm owner Entertainment Network sued, arguing the city used zoning laws improperly to shut the dorm down, saying no customers ever come to the house where the lives of six young women are captured on live videocam. But U.S. District Court Judge Susan C. Bucklew ruled Tampa should wait to argue the case's merits either during a trial or in a petition for summary judgment.

VoyeurDorm's suit goes to trial in December, and the site and house will remain in business pending its outcome, Entertainment Network says.
