Atlanta Tobacco Shop Wins Obscenity Case

This, That and the Other, a Georgia tobacco and accessory shop, recently won a ruling by an 11th U.S. Circuit Court which had previously banned the public advertising of sex toys. In the end, the court found that parts of the Georgia law were unconstitutional.

This, That and the Other, which carries a selection of sex toys and novelties, found a legal loophole in the Georgia state law. Lawyers for the tobacco shop claimed that the ban on sex toy advertising was keeping the only legal segment of sex toy purchasers in Georgia, those interested in sex toys for medical or educational purposes, from knowing about their selection.

United States Circuit Judge Jerome Ferris agreed, and now the Georgia legislature will be forced to reconsider certain parts of the ban.
