LAS VEGAS—AMA Multimedia LLC, parent company of Porn Pros and Passion-HD among others, has filed a copyright infringement lawsuit against Sagan Limited, parent company of Porn.com and TrafficForce.com.
The suit was filed Thursday, April 28, in U.S. District Court in Arizona. Click here to see the complaint and click here to see Exhibit A.
In the suit, AMA Multimedia alleges from November 2015 to the present, Porn.com displayed 64 copyright registered works from Porn Pros and other AMA companies and sites on more than 110 separate and distinct URLs, each a part of Porn.com.
“Defendants ‘scrape’, or aggregate on their own, user information and videos from other websites in the industry, and then create the facade that those users exists on their own website and uploaded the videos to Defendants’ websites directly,” the suit reads.
AMA Multimedia claims Porn.com scraped the content from Videos and/or VPorn and placed it on Porn.com and made it look as if the content had been uploaded by “Users,” but the member profiles were apparently lifted staring from XVideos.com and/or VPorn.com.
In other cases, the suit reads, there were no profile pages attached to the “Users” who uploaded the infringing content, the data showed the content had been uploaded by “Users” before they joined the Porn.com site or, in some cases, that the content was uploaded to Porn.com by “Users” before it had even been produced by AMA Multimedia.
The suit alleges when visitors to Porn.com attempt to click on the infringing content, they were directed to a message that said the movies and clips could only be viewed by paid members of Porn.com.
TrafficForce.com was included in the suit by AMA Multimedia, which claims the ad network took no precautions to ensure its advertisers, in this case Porn.com, are not uploading copyrighted material for their banners on the Traffic Force platform.
AMA Multimedia is seeking up to $150,000 for each infringement and has requested a jury trial in the matter, but no date has yet been set for any hearing.
AVN has requested comment from the defendant but did not receive a reply as of post time.
