LOS ANGELES—The firefighters caught on camera appearing in two videos on Brazzers’ AssesInPublic.com site will not be discliplined, Fire Chief Brian L. Cummings determined today. The officers escaped punishment because the incidents occurred outside the department’s statute of limitations.
In a letter addressed to City Councilman Dennis Zine, Cummings said that the “Fire Department cannot suspend, remove or separate a sworn member from service for acts that are over two years old,” as stated by the city charter.
The videos were produced in 2008.
While the investigation will remain open indefinitely, the councilman said he would look at changing the statute in the charter.
"Whatever happened, they basically have clemency," Zine told L.A.’s NBC4. “We need to look at changing this part of the city charter.”
In one incident, Charley Chase is seen posing on and around a fire truck in Venice Beach with the firefighters watching from a distance. In another video Mariah Milano is walking down Melrose Avenue in Hollywood when a passing firetruck slows down to ever so briefly attempt to talk to her. Milano doesn’t make any physical contract with the truck or the firefighters.
“What happened with the lady on the fire truck was inappropriate,” Zine said. “It should not have happened. But because of the timeframe...there's no discipline they can administer.”
