VIP Shop, Conn. Town Battle in Court

BERLIN, Conn. - A state Supreme Court heard a round of legal arguments Monday in the case of a romance shop opposed by the town in which it hopes to open.

 

The hearing in the case between the store VIP and the middle-class town of Berlin included the latest talks regarding the town's ordinance regulating adult novelty stores and sexually oriented businesses.

Town leaders view the ordinance as a way to control the adult businesses that have arrived in recent years, reportedly upsetting residents and giving the town unwanted limelight.

"Everyone is holding their breath to see what happens with this case," Mayor Adam Salina said after the hearing. "We feel very strongly that we have every right to enact and enforce this type of ordinance."

The town's ordinance bars adult-themed businesses from being located within 250 feet of residentially zoned areas.

VIP still has a federal lawsuit hanging in the balance, along with another state case against Berlin. A state Superior Court judge rejected a lawsuit VIP filed in 2007 to challenge the town's ordinance.
