TULSA, Okla. - A former Creek County, Okla., district judge who was forced to forfeit his retirement pay following felony convictions has filed an appeal to get that money back.
The Creek County Board of Trustees ruled that when Donald D. Thompson was convicted in 2006 for using the device under his judicial robes during four trials in 2002 and 2003, he essentially violated his oath of office and was therefore not entitled to his retirement benefits. Thompson was earning $7789 a month prior to the conviction.
On Tuesday, the 62-year-old filed a petition seeking to reverse the decision, claiming it was "made in haste and a result of conjecture and innuendo and not supported by evidence," the NewsOK.com site reported. He is asking for all, or at least a good chunk, of the benefits to be reinstated.
It was not immediately known when a hearing would be held on the matter.
In addition to losing his retirement benefits, Thomson also spent a year in prison for the convictions. Despite a court reporter's testimony that the judge also exposed himself at least 15 times in court, Thompson claimed the penis pump was a "gag gift" he never used.
