German Supreme Court Reverses Interim Ruling in Megasol v. pjur Case

KARLSRUHE, Germany - According to a press release from lubricant manufacturer Megasol, a new ruling has been handed down in its ongoing trademark infringement battle with pjur group.

The ruling, issued on June 26 by the Federal Supreme Court (BGH) reversed an earlier interim ruling, issued by the Higher Regional Court Frankfurt, which awarded pjur ownership of the questioned trademark. The prior ruling also permitted Megasol to use the trademark without liability, that decision was affirmed and is now final..

The interim ruling by the Federal Supreme Court remanded the case back to the Higher Regional Court Frankfurt for a final decision on ownership of the EROS trademark.

The two lubricant manufacturers have been involved in litigation over the use of trademark materials since separating in 2002. In question have been the "EROS" brands and the image of the male silhouette, which both companies have featured on their products.
