BERLIN/NEW YORK CITY—Novoluto GmbH, which does business as WOW Tech, filed a lawsuit in the US District Court for the District of Oregon on Dec. 31st against Uccellini LLC d/b/a Lora DiCarlo (LDC). WOW Tech seeks to enforce three of its Womanizer Pleasure Air Technology patents against LDC, with the suit charging LDC with patent infringement for making, using, selling and/or importing into the United States LDC's line of Osé, Osé 2, and Baci products.
WOW Tech has stated that it is committed to vigorously enforcing its intellectual property rights against all infringers, including retailers, distributors, and other market participants selling infringing products.
After CDH Investments acquired a substantial stake in the company at the beginning of 2020 and became a main shareholder, WOW Tech set its strategic direction for the coming years with an even stronger focus on innovation and enforcement of its patent portfolio. This partnership, among other things, will allow WOW Tech to continue to invest significant resources in and expand its international network of legal experts. WOW Tech takes patent infringement seriously and is committed to holding patent infringers responsible for violating WOW Tech's intellectual property rights.
"The WOW Tech team is working hard, investing much time, budget, and passion to create new and innovative products. We will make sure that these achievements are protected. Therefore, we act with full force against all those who infringe our patents, be it brands, retailers or distributors," said Johannes von Plettenberg, WOW Tech CEO. "We also have a responsibility to our valued partners who sell our products. We want to ensure that copycats do not harm their businesses and sales."
When contacted by AVN, a representative of Lora DiCarlo gave the following response, which has been lightly edited for content:
In response to the recent lawsuit filed against us by WOW Tech Group, Lora DiCarlo remains committed to our engineering initiatives and innovative sex tech. We value and respect the intellectual property of others within the sexual health and wellness industry.
Additionally, Lora DiCarlo believes in open and fair competition based on high quality products, excellent customer service, and value-driven sexual health education. We welcome innovation, and embrace competition in sex tech.
As in any industry, there are times when sex tech product brands get into intellectual property disputes. Recently, WOW Tech sued Lora DiCarlo for patent infringement. Lora DiCarlo denies these claims and will vigorously defend ourselves in court. Our products implement technology that we own, and we warrant that our products do not infringe upon the intellectual property rights of others. We believe our distributors and retailers have the right to work with any brand that they choose, based on the best interest of their customers.
In the highly unlikely event that a Lora DiCarlo product is found to infringe a patent, we will take back any offending products and issue a credit to our valued retailers.
Lora DiCarlo appreciates the support from our distributor and retail partners in our first year on the market. We sincerely thank those who took a chance on a new brand, and continue to invest their faith in our efforts.
