LOS ANGELES—Little Caprice, the popular model from Czech Republic, says her arbitration win in a cybersquatting case involving her domain names was worth the legal battle.
“It means really a lot for me,” Caprice tells AVN. “The fight took a really long time and it cost us so much money. I’m really happy that the fairness won, as I’m always telling to my husband, the karma see it, and all comes back to us.
“And yes, it was like this. So I’m just happy for it, that’s it…But the biggest thanks comes to [my attorney] Michael Fattorosi, as he did a really great job. And he is really the porn lawyer.”
The Czech star’s domain names LittleCaprice.com and LittleCaprice.net had not been in her control until the World Intellectual Property Organization (WIPO) ruling in late 2017 ordered they be transferred back to her.
Little Caprice contended that respondents from Prague-based ZiboSoftware SRO had been infringing on the European trademark she has on her stage name—which she has held since January 2017. Caprice started her career in 2008; the domain names in question were registered not long after she made her debut in Europe. The respondents claimed to have a 100-year license with her content.
But in December arbitrator Warwick Rothnie ruled the domain names were “identical or confusingly similar” to her trademark, the respondents have “no rights or legitimate interests” with respect to the disputed domain names; and also the names were registered in “bad faith.”
“Usually companies in adult file these types of claims,” Fattorosi says. “It’s unusual that a performer will fight for her domain rights, especially after such a long period of time.”
