LONDON—In a claim filed Monday with the High Court of Justice, Business and Property Courts of England and the Wales Intellectual Property List, Gamelink International has charged cryptocurrency start-up Intimate.io with infringing one of its trademarks; specifically, the small circular symbol with the triad component that has followed the word "Gamelink" roughly since the company was formed 25 years ago.
"This is an action for passing off," the claim reads. "The Claimant markets and supplies the adult entertainment industry goods and services using a three pointed device depicting a thong garment in a circle (the 'Claimant's Sign'). By reason of its continuous trade, and the good and services marketed and sold, under the Claimant's Sign in England and Wales, the Claimant has built up considerable and valuable goodwill and reputation in its business provided under and/or by reference to the Claimant's Sign. The Defendants are using a sign (the 'Defendants' Sign') which is deceptively similar to the Claimant's Sign to attract investment and to market a cryptocurrency which is intended to be used by the Claimant's [sic] customers and potential customers for payment to the Claimant's [sic] affiliates and competitors. The Defendants have thereby, in the course of trade, passed off and/or have attempted, threatened, and/or enabled or assisted others, to pass off their business and services, not being a business or services of the Claimant or a business or services associated with or connected with Claimant, as and for such a business and services."
The claim states that further details will be provided later.
What Gamelink is looking to do is to prevent Intimate and its officers and/or management from further utilizing the sign, and prevent the company from claiming or appearing to claim that it has any relationship to Gamelink whatsoever. It also wants Intimate to destroy any documents, images or other materials that incorporate the sign in question. Gamelink is also looking for an accounting of Intimate's profits in case the court finds that Intimate has damaged the company monetarily.
Intimate has yet to respond to Gamelink's claim.
