NEW YORK - A male go-go dancer and model has sued HX magazine for identifying him as a "porn star".
Manuel Alex Saez said he endured "emotional and mental suffering and distress, and sleeplessness and aggravation" after the publication ran a photo of him with the caption "Big City Video porn star Alex."
Saez's libel suit asks for a hefty $1.25 million in damages. The staff at HX magazine claims they had received the information concerning Saez's purported link to pornography from the nightclub where he the photo was taken.
According to the New York Post, Supreme Court Justice Emily Goodman has ruled to let Saez go forward with the suit, deciding that the magazine "does admit that no investigation was done" to determine if he was a porn star.
Alan Effron, a lawyer for the publication, told the New York Post that Goodman's ruling was "unfortunate," but predicted that the court would eventually find "the magazine acted responsibly."
