A twelve-year old boy received an accidental education when he watched the DVD included in his newly purchased Reject magazine. Instead of young men thrashing through skateparks, the boy found himself watch the likes of Kyle Wilde, Markie, and other gay porn stars thrashing around in Dick Wadd Video's Hard Hat Pigs.
Now the mother of the boy is suing Barnes & Noble, the retailer who sold the magazine to the boy, after complaints to the local management and national executives failed to result in a satisfying resolution.
The suit seeks unspecified damages for his suffering, emotional pain, medical costs for therapy, loss of enjoyment of life, loss of earnings and earning capacity, special damages, general damages, and punitive and exemplary damages.
Reject has been sold throughout the Barnes & Noble chain without any incident in the past. The magazine that included the gay porn DVD in a plastic sleeve of the magazine came out last month.
According to Wes Driven, the editor of Reject, about 10 percent of the magazines reportedly carried the DVDs due to a copying error.
Local management personnel do not intend to fire or reprimand anyone at the West Bountiful Barnes & Noble.
The day after the DVD was discovered, all 500-plus stores in the chain were instructed to remove the issue from their shelves.
