GATESHEAD, England – The Crown Prosecution Service has decided that a photograph seized by police from an exhibition at the Baltic Centre of Contemporary Art is not child porn.
Entitled “Klara and Edda Belly-Dancing,” the depiction of two nude girls by world-renowned photographer Nan Goldin was one of 149 works on loan to the gallery exhibition from singer Elton John's private collection.
Following the seizure of the photo, John came forward as the owner and defended the work in a statement on his website.
The collection carried content warnings alerting visitors to the graphic nature of the exhibits.
According to Sky News, the CPS decided there was insufficient evidence to “justify proceedings for offenses of possession or distribution of an indecent photograph.”
The photo was also considered by the CPS in 2001, and was deemed not indecent at that time as well.
