Evil Angel, producing studio of AVN Award -sweeping The Fashionistas, is preparing to sue ABC Television for copyright infringement allegedly incurred on that network's PrimeTime series.rnrn
E.A. General Manager Chris Norman told AVN.com that the company is starting litigation against ABC for unauthorized use of Fashionistas imagery and audio in promos for and during the Shattered Lives segment, featuring Fashionistas star Belladonna.rnrn
"Their recourse will probably be 'fair use'," Norman said, "but they split the soundtrack (to Fashionistas) and used it over interview segments and even footage of other companies' films."rnrn
Norman noted that ABC had not approached Evil Angel for a release to use his company's footage. He feels the hubris of the network in not asking permission is indicative of a common problem.rnrn
"It is our belief that they decided since we are 'merely pornography' that we would allow our copyright to be exploited."rnrn
Evil Angel is employing intellectual property firm Greenberg & Bass in the filing, which will take place "very shortly."
