Louisville Adult Ordinance Challenged in Court of Appeals

An attorney representing PT's Show Club, a gentlemen's club in Louisville, has asked the state Court of Appeals for a second chance to argue against a stringent city ordinance regulating adult businesses.

Attorney Bradley Shafer is seeking an injunction against the law, saying that he should be allowed to argue in Jefferson Circuit Court that strip clubs and peep shows do not harm the community with "secondary effects" of drug use, violent crime and prostitution, according to a recent published report in the Courier-Journal.

"The ordinance should be invalidated," Shafer told the Courier-Journal. His claim stems from a circuit court ruling to uphold the ordinance in 2004. Shafer said that arguments against secondary effects were not made at that time.

"You can control secondary effects, but you can't put them out of business," Shafer said of his client.

The current law says that adult businesses must be closed between 1 a.m. and 9 a.m., strip club dancers must wear pasties and g-strings, adult business owners must be licensed, as well as prohibits customers from giving tips directly to the dancers.

The three-judge Appeals Court panel listened to arguments from both sides and will hand down a decision in four to six weeks.
