Ducati Sues Skeeter Kerkove Over Breach of Contract

Kevin Ducati, owner of Ducati Productions, has filed a lawsuit against Skeeter Kerkove, claiming the veteran director breached his contract by selling him exclusive rights to scenes that were previously sold to other producers.

In his suit filed in Los Angeles Superior Court on July 10 but served on Kerkove last week, Ducati alleges that Kerkove agreed on March 19, 2005 to produce and supply him with five scenes on an exclusive basis. But last February, Ducati claims he learned the scenes that Kerkove sold to him had also been sold to another unnamed company.

“I found that out through postings on the Web and I checked it out with that other company and I was told we were both sold the same scenes,” Ducati said, referring to scenes in the Kerkove-produced titles Welcome to the Bung Hole #1.

Ducati also alleges that Kerkove also breached his contract by providing a movie that did not contain the agreed upon cast.

But Kerkove denied the allegations, claiming the entire lawsuit is frivolous and that he plans to counter-sue.

“When I turned in the movie, he didn’t say one negative thing about it. Everything was fine until I mentioned that he still hadn’t paid Hillary Scott for her scene (in the movie),” Kerkove said.

“Then that’s when all this started. I think Kevin Ducati is desperate and is trying anything to get back at me.”

Kerkove claims that Ducati eventually paid Scott, but only after he insisted that he pay her. Ducati denied the allegations, saying Kerkove is trying to dodge the issue.

“It’s about the fact he gave me scenes that he sold to another company. It’s not about anything else.”

Ducati said when he released Welcome to the Bung Hole #2, last fall, he began receiving scores of returns likely because word got out that Bung Hole #1 contained scenes from other movies.

In his suit, Ducati is seeking an unspecified amount for both actual and punitive damages.

Ducati Productions was established in 2001, specializing in gonzo series such as Strap-On Chicks and Pigtail Cuties, among others.

Kerkove is a multiple AVN-nominated director and performer, known for his August release Sex and Submission from Robert Hill Releasing, and last year’s Vivid title Collision Course, with Briana Banks and Tera Patrick.
