Barbie Cummings: 'I'm Not A Victim'

KNOXVILLE, Tenn. - Porn starlet Barbie Cummings will not be the star witness the Tennessee District Attorney's office might have hoped for in the state's highly publicized case against former state trooper James Randy Moss.

Moss faces possible criminal charges of official misconduct and tampering with evidence stemming from his on-duty tryst with Cummings. While issuing the Blacks On Blondes contract girl a speeding citation on May 7, the officer allegedly threw away prescription painkillers found in Cummings' car before receiving oral sex from the porn starlet. Moss reportedly shot video and photos of the encounter.

Cummings is now speaking out on Moss' behalf. "This is just stupid," she told the Knoxville News-Sentinel. "I'm not a victim. I guess I'm going to get up in that courtroom and say I (gave him oral sex) because I wanted to."

Prosecutors, however, do not seem concerned with whether the sexual encounter was consensual or not. The office of Wilson County Assistant District Attorney David Durham is currently building a criminal case against Moss with evidence including the surveillance video from Moss' patrol car.

The Tennessee Highway Patrol fired Moss last week, giving him the option of a hearing before he is officially dismissed. Moss was later allowed to resign, because earlier in the day, he had sent a letter of resignation, though officials said that they didn't know about the letter until after they had notified him he was fired.

According to the News-Sentinel, investigators are also looking into a series of complaints from other women against Moss, which have come up since the story broke earlier this month.

"We anticipated getting other complaints and they're job now is to separate the fact from the fiction, which is what they're doing," Durham said.

"I think all of us can assume that this is not the way taxpayers want to spend money...and this is not the way you want a professional to act because they do work for all of us out there."
