Albuquerque Considers Ban on Adult Businesses in Downtown

City officials are considering imposing a moratorium on new adult businesses seeking to move into its downtown area.

City Council members said they wanted to help revitalize the area by keeping adult businesses from moving in, the Albuquerque Tribune reported.

City Attorney Bob White said new adult businesses in the city’s downtown zone would be inconsistent with any revitalization plan for that area.

White noted that the city has the right to control where adult businesses are located without violating the Constitution, as it did in the 1970s when adult businesses were restricted to area.

If approved, the moratorium would be in effect for six months in order to give the city enough time to develop permanent new regulations for such businesses, White explained, adding that the moratorium isn’t aimed at preventing any particular business from the area.

Council member Isaac Benton will introduce the proposal at an upcoming meeting at the request of Mayor Martin Chavez.
