Kansas Adult Businesses Battle Zoning Law

WICHITA, Kan. – Three adult-oriented businesses are fighting back against the city, in hopes that they won’t be relocated to a special city zone.

The businesses were ordered to move after a 2005 adult law went into effect this month, following a two-year grace period. The law requires adult businesses to set up shop at least 500 feet away from churches, schools, and like businesses.

Nine businesses are affected by the new law, but only four have moved. Three adult businesses are refusing to relocate, claiming that the new law is unconstitutional, while two others are still negotiating with city officials.

The ordinance was urged by right-wing groups such as Operation Southwind.

“The city will, on their own, just test the constitutionality of the zoning ordinance before they press charges to enforce it,” Operation Southwind member Jan Beemer told OneNewsNow.com. “If, in court, the judge rules it constitutional, then they will press charges against the three stores.”
