Judge Dismisses Britney Spears’ Sex Tape Suit

LOS ANGELES - A Superior Court Judge has dismissed a lawsuit filed by Britney Spears against US Weekly magazine which she claims fabricated a story about a sex tape featuring her and her husband.

Los Angeles Superior Court Judge Lisa Hart Cole dismissed the suit, saying there was little chance that Spears could prevail in her argument that the tabloid made up the story about the alleged tape, CNN reported.

Spears filed the suit last year, seeking $10 million in damages from the magazine, which ran the article in its “Hot Stuff” column in October 2005.

In her suit, Spears alleged the magazine had defamed her by publishing a rumor about her and her husband making a sex tape.

But Cole ruled that Spears could not be defamed by the article since she had made a career of portraying her sexuality “on the public eye.” Thus, whether the story was true or not, would not have defamed her, the Judge ruled.

The story claimed Spears and her husband Kevin Federline, feared the release of the sex tape, which they reportedly had viewed with their estate planning lawyers. The article said that Spears and Federline were “acting goofy the whole time” while watching the video.
