Bang Bros Settles Syphilis Suit With Lylith LaVey-UPDATED

LOS ANGELES—Adult performer Lylith LaVey, who was granted a summary judgment of $129,360 against fellow performer Mr. Marcus after she alleged that Marcus had altered an STD test and exposed her to syphilis during a scene for the movie Diesel Dongs 25 that they shot on July 24, 2012, has now also settled with the production company behind the movie, Bang Bros, for an undisclosed sum.

In fact, although Marcus had had syphilis at one point a month before the scene, he had reportedly been successfully treated for the disease, although the test which he presented at the time of the shoot did not reflect that, but that test had not been altered.

LaVey first filed suit against Marcus on September 5, 2012, after the actor had pled "no contest" in June of 2012 to two misdemeanor counts of having exposed two performers, one of whom was LaVey, to a communicable disease. Marcus was sentenced to 30 days in jail for the offense, required to perform 15 days of community service, and to serve a 36-month probation. Marcus has stated that he only pled to the misdemeanor charges to avoid spending more time in jail than the 10 days he had already served while awaiting a bail reduction. When Marcus did not respond to LaVey's lawsuit, the Los Angeles Superior Court granted her motion for summary judgment in September of 2013—a judgment that Marcus has said he is in the process of appealing.

However, on February 11, 2014, LaVey filed an additional lawsuit against Bang Bros, charging that the company "should have known that actor [Mr. Marcus] had the communicable disease." Although LaVey did not contract the disease, she claimed to have "suffered emotional distress as well as castigation from others in her field as a result of the incident."

While court records reflect that LaVey's lawsuit against Bang Bros has been in progress for more than 13 months, on March 13, her attorneys informed Judge Teresa Baudet, who was assigned to the case, that the matter had been resolved. At this point, no details of the settlement with the company have been made public.
